Old property deeds and a decades-old condemnation judgment have determined whether Florida landowners are entitled to compensation after a former railway corridor was considered for conversion into a public recreational trail. On October 22, 2026, the US Court of Appeals for the Federal Circuit affirmed a lower court ruling that rejected claims involving approximately 7.68 miles of the Venice Branch railway corridor. How the dispute began with a proposed trail
The case arose after Seminole Gulf Railway, the corridor’s operator, filed a notice seeking an exemption to abandon the Venice Branch in March 2019. In response, the Sarasota County Board of County Commissioners asked the Surface Transportation Board (STB) to preserve the corridor for public use and interim trail development.The STB subsequently issued a Notice of Interim Trail Use (NITU) under the National Trails System Act Amendments of 1983. The mechanism allows an unused railway corridor to be preserved for potential recreational trail use instead of being legally abandoned, a process commonly known as railbanking.The arrangement can create a property dispute when a railway holds only an easement. Ordinarily, if railway operations end, the underlying property rights may revert to adjacent landowners under applicable state law. A NITU can prevent that reversion while the corridor remains available for trail use, potentially creating a compensable taking by the federal government.The landowners argued that this was precisely what had happened. They maintained that historical conveyance deeds and a 1926 condemnation judgment had granted the railroad only limited rights to use the land for railway purposes. Why the old deeds became central to the case
The dispute depended on the distinction between an easement and ownership in fee simple. An easement generally grants a specific right to use another party’s property, while fee simple ownership represents a much broader ownership interest. The railway’s interest in the corridor originated partly in deeds from several former property owners and companies, including Sarasota Land Company, Clough, Burton, Neihardt, Florida Mortgage and Investment Company, and Ringling. The landowners argued that these transactions conveyed railway rights-of-way rather than complete ownership of the underlying land.However, the Federal Circuit agreed with the lower court that the deeds’ wording conveyed the land itself. The documents used broad language granting, selling and conveying the grantors’ rights, titles and interests in described parcels. What the 1926 condemnation judgment established
A separate part of the dispute concerned a condemnation proceeding involving the Tampa Southern Railroad Company. The proceeding resulted in a jury award of $61,500 for property taken for railway use, followed by a judgment allowing the property to be appropriated as a railway right-of-way. Unlike the conveyance deeds, the condemnation judgment did not clearly establish whether the railroad acquired full ownership or only an easement. The Federal Circuit therefore examined additional records from the original proceeding, including proposed jury instructions submitted by both sides and a joint stipulation describing the property.Those documents showed that the parties and the jury had focused on the value of the land being taken, rather than simply the value of a right to use it. The court concluded that this evidence resolved the ambiguity in favour of fee simple ownership. The judges also rejected the landowners’ request to refer the legal question to the Florida Supreme Court, finding that existing Florida law provided sufficient guidance.
Why the appeals court rejected compensation
